Illinois Drunk Driving Laws

DUI:

bulletConviction remains on a driver’s record for life
bulletClassified as a violent crime
bulletMandatory revocation of vehicle registration
bullet1st conviction - Class A Misdemeanor: Mandatory driver’s license revocation for a minimum of one (1) year for (two (2) years if under age 21).
bullet2nd conviction - Class A Misdemeanor: 5-year driver’s license revocation and 48 consecutive hours in jail or 10 days community service.
bullet3rd conviction - Class 4 Felony: 10-year driver’s license revocation.
bullet4th or subsequent conviction - Class 4 Felony: Lifetime driver’s license revocation.

AGGRAVATED DUI:

A third or subsequent DUI conviction, DUI crash resulting in great bodily harm, or DUI while driving a school bus:

bulletClass 4 Felony.

RECKLESS HOMICIDE:

A DUI crash resulting in death:

bulletClass 2 Felony.
bullet2-year minimum driver’s license revocation.

CHILD ENDANGERMENT:

DUI while transporting a child under age 16:

bulletMandatory fine of $500 to $2500
bullet5 days community service benefiting children (10 days for a repeat offender)

CONTRIBUTING TO DUI:

Knowingly allowing a person to operate your vehicle under the influence of alcohol or other drugs:

bulletClass A Misdemeanor.

DRIVING WHILE SUSPENDED OR REVOKED:

If driver’s license suspension or revocation was for DUI, leaving the scene of a personal injury/fatal crash, or reckless homicide:

bulletDouble the original suspension period or a 1-year extension of the revocation.
bulletClass A Misdemeanor for 1st conviction with a mandatory 7 days in jail or 30 days community service.
bulletClass 4 felony for 2nd conviction
bulletClass 3 felony for 3rd conviction
bulletClass 2 felony for 4th or subsequent conviction

OPEN CONTAINER:

It is illegal for ANYONE to transport or posses an alcoholic beverage in the passenger area of a vehicle when it is no longer in its original package or when the seal has been opened or broken. In addition to the passengers being charged and assessed fines and penalties by the court, the driver’s conviction also will be added to the driving record and can result in the following actions:

bullet1st offense over 21 - point assigned conviction; Under 21 - 1-year driver’s license suspension.
bullet2nd conviction over 21 - 1-year driver’s license suspension; Under 21 - revocation
bulletOfficer can charge all passengers and the driver for one violation/open container
bulletChartered buses not for school use, limousines, motor homes, and mini-motor homes are exempt.

VEHICLE IMPOUNDMENT AND SEIZURE:

Vehicles may be impounded for a DUI arrest or driving while suspended or revoked for a pervious DUI offense:

bullet12 hours for 1st offense
bullet24 hours for 2nd offense
bullet48 hours for 3rd offense

Vehicles may be seized for public auction when used to commit:

bulletReckless homicide for DUI while driver’s license was suspended or revoked for a previous DUI
bulletA 3rd or subsequent DUI offense
bulletDUI while suspended or revoked for reckless homicide.

Possible imprisonment up to one year

 

Fines of up to $25,000

Possible 3-14 years imprisonment for reckless homicide

Possible up to 28 years imprisonment of multiple deaths
